These Terms of Service ("Terms") govern your use of the BrainBack educational platform available at https://brainback.top (the "Website"), our mobile applications (iOS and Android), and related services (collectively, the "Platform"). By accessing or using BrainBack, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree with these Terms, please do not use the Platform.

1. Description of BrainBack

BrainBack is an educational video platform designed for teenagers (ages 13-18) that transforms screen time into learning time. Our Platform features:

• Bite-sized educational videos (15-120 seconds) across STEM, languages, humanities, creative arts, and life skills
• Interactive quizzes with instant feedback after each video
• AI-powered tutoring for personalized learning assistance
• Gamification features including XP, daily streaks, achievement badges, and skill maps
• Micro-courses (premium bundles of 5-15 curated videos) available for one-time purchase
• Safe social interactions through emoji reactions and short video replies (no text comments)
• Parental dashboard for monitoring and control

2. Eligibility and Account Requirements

2.1 Age Requirements
• Users must be at least 13 years old to create an account independently
• Users under 13 may use the Platform only with verifiable parental consent and under parental supervision via our Parent Dashboard
• Users under 18 should have a parent or guardian review these Terms

2.2 Account Creation
• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized access to your account
• Each account is for individual use only; sharing accounts is prohibited

2.3 Parental Responsibility
• Parents/guardians of users under 18 are responsible for monitoring their child's use of the Platform
• Parents can access the Parent Dashboard to view learning progress and manage safety settings

3. User Conduct and Community Guidelines

To maintain a safe and productive learning environment, users agree to:

• Respect intellectual property rights

3.2 Prohibited Activities
You may NOT:
• Post, share, or create content containing violence, hate speech, bullying, harassment, or discrimination
• Upload or share sexually explicit, inappropriate, or age-inappropriate content
• Impersonate others or create fake accounts
• Attempt to hack, reverse engineer, or compromise the Platform's security
• Use bots, scripts, or automated tools to access the Platform
• Spam, advertise unauthorized products/services, or engage in commercial activities without permission
• Share personal contact information (phone numbers, addresses, etc.) in public content
• Encourage dangerous activities, self-harm, or illegal behavior
• Violate any applicable laws or regulations

3.3 Content Moderation
• All user-generated content (video replies, emoji reactions) is subject to AI and human moderation
• We reserve the right to remove content that violates these Terms or our Community Guidelines
• Repeated violations may result in account suspension or termination

4. User-Generated Content

4.1 Video Replies and Interactions
• Users can create 15-second video replies to educational content
• Users can react to videos with emoji reactions
• By posting content, you grant BrainBack a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content on the Platform

4.2 Content Ownership
• You retain ownership of any content you create
• You are solely responsible for the content you post
• You represent that your content does not infringe on any third-party rights

4.3 Content Removal
• You may delete your content at any time through the Platform
• We may remove content that violates these Terms without notice

5. Educational Content and Intellectual Property

5.1 Platform Content
• All educational videos, quizzes, AI tutor responses, and platform materials are owned by BrainBack or licensed from content creators
• Content is protected by copyright, trademark, and other intellectual property laws
• You may not download, reproduce, distribute, or create derivative works from platform content except as expressly permitted

5.2 Micro-Courses
• Purchased micro-courses are for personal, non-commercial use only
• You may download courses for offline viewing on your personal devices
• You may not share, resell, or redistribute purchased courses
• All micro-course content remains the property of BrainBack and the original creators

6. Payments and Purchases

6.1 Pricing
• BrainBack offers a free tier with unlimited access to the video feed, quizzes, AI tutor, and gamification features
• Micro-courses are available for one-time purchase ranging from $2.99 to $9.99
• All prices are in USD and subject to change with notice

6.2 Payment Processing
• Payments are processed securely through Stripe
• You must provide accurate payment information
• By making a purchase, you authorize us to charge your payment method

6.3 Refund Policy
• Micro-course purchases are eligible for a full refund within 7 days of purchase

• Refunds will be processed to the original payment method within 5-10 business days
• After 7 days, all sales are final

6.4 Subscriptions (Future Feature)

• The AI tutor is not a substitute for professional educational services or human teachers

• You can adjust personalization settings in your account preferences

8. Parental Controls and Monitoring

8.1 Parent Dashboard
• Parents of users under 18 can access the Parent Dashboard to:
  - View learning metrics (minutes watched, topics explored, badges earned)
  - Monitor progress reports and course completions

  - Control ad settings (enable/disable ads)
  - Manage account permissions

8.2 Parental Rights
• Parents can request access to, correction of, or deletion of their child's data
• Parents can terminate their child's account at any time

• Content must not violate intellectual property rights
• Misleading, false, or harmful educational content is prohibited

9.3 Revenue Sharing
• Creators earn revenue from micro-course sales featuring their content
• Revenue sharing percentages and payment terms are outlined in the Creator Agreement
• Payments are processed monthly for earnings above the minimum threshold

9.4 Creator Tools
• Creators have access to analytics, auto-captions, AI quiz generators, and interactive doodle layers
• These tools are provided as-is and may be updated or modified at any time

• We are not liable for indirect, incidental, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid to BrainBack in the 12 months preceding the claim
• Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you

13. Indemnification

You agree to indemnify, defend, and hold harmless BrainBack, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:
• Your use of the Platform
• Your violation of these Terms
• Your violation of any third-party rights
• Content you post or share on the Platform

14. Account Termination

14.1 Termination by You
• You may delete your account at any time through account settings
